CC MIN 102114City Council Regular Meeting Minutes Tuesday, October 21, 2014 6:00 PM Call to Order /Pledge of Allegiance Mayor Freed called the meeting to order at 6:00 PM and led the Council in the Pledge of Allegiance. 1. Roll Call Councilmembers Agnew, Evans, Lamb, Rheaume, Samberg and Mayor Freed present. Deputy Mayor Spivey absent and excused. 2. Meeting Agenda Approval Mayor Freed announced that AB 14 -159: Consideration of Approval of Agreement and Easement for Electric System with Puget Sound Energy, Inc. for the new Bothell City Hall Building has been pulled from the agenda and will be rescheduled. Councilmember Evans added 30 minutes to the discussion of AB 14 -163 - the Public Hearing. Councilmember Samberg pulled AB 14 -156 (Approval of the Surface Use Agreement with King County regarding 1st Lt. Nicholas Madrazo Memorial Park) from the Consent Agenda for discussion/ clarification. 3. Review Projected Agenda No changes. ADDED ITEM. Mayor Freed presented outgoing Planning Commission Member Peter Battuello with a certificate of appreciation for his service. Councilmember Lamb took a moment of Personal Privilege and stated Bothell Firefighter Kelly Melton is volunteering her time to assist in the efforts with the Ebola epidemic in Sierra Leone. Visitors Hanna Welander - spoke regarding the proposed closure of Northshore Public Health; submitted her comments for the record and asked the Council for a resolution opposing the closure. Sandy Guinn spoke regarding the Regional Fire Authority and submitted a petition and her comments for the record. Pam Bellew - spoke regarding the upcoming ballot measure on the November 4, 2014 election. Thomas Monahan Boy Scout Troop 420 - asked for suggestions for community service projects. Assistant City Manager Peter Troedsson gave him his contact information. 5. Consent AEenda a. Consider Approval of the October 7, 2014 Regular Meeting Minutes and the October 14, 2014 Study Session Minutes RECOMMENDED ACTION: Approve the City Council Meeting Minutes of October 7, 2014 and October 14, 2014. b. AB #14 -155 -Consider Approval of September 2014 Vouchers RECOMMENDED ACTION: Approve checks 123726 through 124274 ($3,054,440.15) for September 2014 that were approved and paid by the City Auditor. AB #14 -157 - Consider Approval of Interlocal Agreement with King County for Use of Electronic Fingerprint Equipment provided by the Regional AFIS Program RECOMMENDED ACTION: Authorize the City Manager to execute the Interlocal Agreement with King County for use of the electronic fingerprint equipment provided by the regional AFIS program, in substantially the same form as presented. AB #14 -158 - Consider Approval of Amendment to the Interlocal Agreement Between City of Bothell and City of Sunnyside for the Housing of Inmates. RECOMMENDED ACTION: Approve Amendment to the Interlocal Agreement with King County for jail services in substantially the same form as presented; and authorize the City Manager to execute the amendment. g. AB # 14 -160 - Consider Approval of Ordinance Approving Indirect Change of Control of Time Warner Telecom of Washington Franchise RECOMMENDED ACTION: Adopt the Ordinance approving indirect change of control of Time Warner Telecom of Washington Franchise. MOTION: Councilmember Lamb moved approval of Consent Agenda items a, b, d, e and g. Councilmember Agnew second. The motion carried 6 -0; Deputy Mayor Spivey absent and excused. Consent Agenda Item c - AB 14 -156 - Consider Approval of Surface Use Agreement with King County regarding 1st Lt. Nicholas Madrazo Memorial Park RECOMMENDED ACTION: Authorize the City Manager to enter into a Surface Use Agreement with King County regarding the 1st Lt. Nicholas Madrazo Memorial Park and in substantially the same form as presented. Councilmember Samberg asked clarifying questions of Recreation and Park Planning Manager Pat Parkhurst. MOTION: Councilmember Samberg moved approval of AB 14 -156. Councilmember Lamb second. The motion carried 6 -0; Deputy Mayor Spivey absent and excused. 6. Contracts & AEreements a. AB #14 -161- Consider Interlocal Agreement for Participation with East Metro Training Group RECOMMENDED ACTION: Authorize the City Manager to sign the Interlocal Agreement for the purpose of cooperative and coordinated training activities and administration. Ordinances & Resolutions a. AB # 14 -162- Consider Approval of City of Bothell Hazard Mitigation Plan Annex to the King County Regional Hazard Mitigation Plan RECOMMENDED ACTION: Adopt the proposed resolution to approve the City of Bothell Hazard Mitigation Plan Annex to the King County Regional Hazard Mitigation Plan. Emergency Preparedness Coordinator Jennifer Warmke presented and reviewed the plan. MOTION: Councilmember Agnew moved approval of the recommended action as presented. Councilmember Lamb second. The motion carried 6 -0; Deputy Mayor Spivey absent and excused. 8. Public MeetinEs. Public HearinEs. Closed Record Reviews a. AB #14 -163 - Continued Public Hearing on Potential Plan and Code Amendments Concerning 1) the Bothell Connector Alignment Between 228th and 240th Streets SE, and 2) Land Use Designations and Development Regulations for Portions of the Fitzgerald / 35th SE and Canyon Creek / 39th SE Subareas; and Consideration of Proposed Findings, Conclusions and Action and a Proposed Ordinance Approving the Amendments RECOMMENDED ACTION: After taking testimony, closing the public hearing, and deliberating, move and vote to adopt the proposed Ordinance. Planning Manager Gary Hasseler presented and entered several exhibits into the record. He also summarized Council direction received on 9/16/14.
