I TO CITY OF BOTHELL 1 D- - 0 ORIGINAL PARK AT BOTHELL LANDING HISTORICAL BUIDINGS LEASE BETWEEN CITY OF BOTHELL AND BOTHELL HISTORICAL MUSEUM SOCIETY 1. Parties This Supplemental Agreement No. 1 to the Lease Agreement is entered into as of the Effective Date specified below, and supplements that certain Park at Bothell Landing Historical Buildings Lease, dated January 1, 2003, and the exhibits thereto ( "Original Agreement "), between the City of Bothell, a Washington municipal corporation having its principal place of business at 18305 101st Avenue N.E., Bothell, Washington 98011 ( "Lessor "), and the Bothell Historical Museum Society a non - Profit organized under the laws of the State of Washington, located and doing business at 9919 NE 180 St., Bothell Washington 98011 (Lessee "). 2. Recitals 2.0 The Bothell Historical Society has entered in to a 10 year Lease for the use of the Historical Buildings known as the Hannan House, Bothell's First School House and the Beckstrom Log Cabin. The 10 year term of the lease is from January 1, 2004 through December 31, 2013. 2.1 The Bothell Historical Society desires to modify, delete and /or add services, and/or change conditions set forth in the Original Lease Agreement. 2.2 City agrees to modify, delete and/or add services, and/or change the contract provisions set forth in the Original Agreement (and any prior supplemental agreements). NOW, THEREFORE, in consideration of the mutual benefits and promises set forth herein, it is agreed by and between the Parties as follows: 3. Modifications, Deletions or Additions to Original Terms and Conditions. 3.0 Section 4 Use of Premises is hereby amended to read as follows: The leased premises shall, throughout the entire term of this lease, be occupied and used for BOTHELL HISTORICAL MUSEUM, and for no other purpose. The buildings shall be open to the public, at a minimum, from May to September of each year, 1:00 PM to 4:00 P.M. Sunday (except holidays), and hours of operation shall be clearly posted. However, Lessee shall be excused from the responsibility of meeting this requirement starting March 1, 2010 through December 31, 2012 or the completion of the Crossroads construction project, whichever comes first. 3.1 Section 16 Exterior Signs and Symbols is hereby amended to read as follows: It is understood and agreed that all signs or symbols placed on the exterior on the leased premises by the Lessee shall be approved in advance by the Lessor and shall comply with the City of Bothell regulations and ordinances relating to signs, as they exist now or are hereafter amended. 3.2 Ratification All provisions of the Original Agreement and any supplemental agreements thereto shall remain in full force except as expressly amended by this Supplemental Agreement. 4.
