CC MIN 012114City Council Regular Meeting Minutes Tuesday, January 21, 2014 6:00 PM Bothell Municipal Court 10116 NE 183rd Street, Bothell, WA Call to Order /Pledge of Allegiance Mayor Freed called the January 21, 2014 Regular Meeting to order at 6:00 PM and led the Pledge of Allegiance. 1. Roll Call Councilmembers Agnew, Evans, Lamb, Rheaume, Samberg, Deputy Mayor Spivey and Mayor Freed present. 2. Meeting Agenda Approval The meeting agenda was approved as presented. 3. Review Projected Agenda There were no changes to the projected agenda. 4. Special Presentations AB #14 -11- Presentation by Flotilla 21 of the Coast Guard Auxiliary City Clerk Laura Hathaway introduced Coast Guard Auxiliary Flotilla Commander Garrison Bromwell and Division Commander Gary Proudlock who presented a proclamation to the Parks and Recreation Department for their efforts in educating Bothell citizens in boating safety. 5. Consider Approval of Draft Minutes of Regular Meetings of January 7, 2014 Regular Meeting and January 14, 2014 Study Session - January 14, 2014 Pulled for discussion b. AB #14 -12 - Consider Adoption of Fiberoptic Franchise Agreement with McLeodUSA Telecommunications Services, LLC Councilmember Evans pulled the Consent Agenda Item a: January 14, 2014 Study Session Minutes. MOTION: Councilmember Lamb moved approval of the Consent Agenda as amended. Councilmember Agnew second. The motion carried unanimously 7 -0 Consent Item a - January 14, 2014 Meeting Minutes: Councilmember Evans made clarifying comments regarding his prior Council Committee report. MOTION: Councilmember Lamb moved approval of the January 14, 20014 Meeting Minutes as amend. Councilmember Evans second. The motion carried 7 -0. 7. Contracts & Agreements None 8. New Business - continued a. AB #14 -13 -Consider Appointments to 2014 Council Committees Mayor Freed reviewed the committee appointments that council expressed interest in at the January 14, 2014 Study Session. He gave Councilmember Agnew the opportunity to change any committee assignments for which he was considered. Discussion ensued. MOTION: Councilmember Lamb moved approval of the 2014 Council Committee Assignments. Councilmember Evans second. The motion carried unanimously 7 -0. 9. Old Business None City Council Minutes January 21, 2014 Page 3 of 5 10. Public Meetings, Public Hearings, Closed Record Reviews a. AB #14 -14 - Public Hearing to Consider Approval of Resolution to Update the Parks, Recreation and Open Space Action Plan (PROSAP) Recreation and Park Planning Manager Pat Parkhurst presented AB 14 -14 introduced Park Board members who were on hand to answer council questions. Park Board Member Rhonda Seiber -Doane spoke to their recommendations. Mayor Freed opened the public hearing at 6:20 PM. Public testimony was heard from: • David Bain • Jim Freese • Steve Seiller Councilmember Evans thanked the Park Board for their hard work and reviewed a list of proposed revisions to the plan. (Note: List of proposed changes is on file with the City Clerk's office.) Councilmember Samberg suggested edits to the preamble and the appendix. Councilmember Lamb left the meeting at 6:41 PM and returned at 6:44 PM. Discussion ensued regarding Councilmember Evan's and Councilmember Samberg's proposed revisions. Councilmember Agnew was excused at 7:16 PM. MOTION: Councilmember Lamb moved to close the public hearing. Deputy Mayor Spivey second. The motion carried 6 -0 -1 with Councilmember Agnew absent and excused. Mayor Freed closed the public hearing at 7:18 PM. City Council Minutes January 21, 2014 Page 4 of 5 MOTION: Councilmember Lamb moved approval of the Resolution adopting the Parks, Recreation, and Open Space Action plan, incorporate all changes proposed by Councilmember Evans; include a language change suggested by Councilmember Samberg in the preamble that states: "According to the office of Financial Management (OFM) by 2025, the population is expected to reach 44,500 in the city's current boundaries, and the remaining urban growth area includes a combination population with projected population in our unincorporated planning area that utilize Bothell's park facilities." He further moved to add a list of accomplishments in the appendix and amend PR G5 to state: "To acquire and develop land for active park and recreation facilities particularly in the Snohomish County portion of Bothell." Councilmember Evans second. Discussion ensued. Councilmember Lamb clarified that his motion is intended to include the priority projects but not "other priority projects." Councilmember Evan's agreed with both clarifications. AMENDMENT: Councilmember Samberg moved to reword PR P5 as originally proposed by the Parks Board. Mayor Freed second. VOTE: The amendment failed as follows: Ayes: Rheaume, Freed Noes: Samberg, Lamb, Evans, Spivey Abstain: None Absent: Councilmember Agnew AMENDMENT: Councilmember Rheaume moved to incorporate the language on PR P25 in the staff report to match the PR P25 PROSAP language. Councilmember Samberg second. Discussion ensued. VOTE: The motion failed on a 3 -3 -0 -1 tie vote. VOTE on MAIN MOTION: The motion carried unanimously 6 -0 -1; Councilmember Agnew absent and excused. City Council Minutes January 21, 2014 Page 5 of 5 ADDED ITEM: City Manager Bob Stowe asked for and received council consensus on the upcoming Council retreat agenda. 11. Executive Session - PropertyAcquisition /Personnel Matters /Potential/Pending Litigation/ Labor Relations - Possible Action Council adjourned to executive Session to discuss Pending Litigation at 7:55 PM for approximately 30 minutes with action expected. Council reconvened at 8:04 PM MOTION: Councilmember Lamb moved approval to authorize the City Manager to approve a settlement agreement with the Washington Stated Department of Ecology regarding a NPDES Phase II permit appeal, various definitions in the 1 -acre threshold stormwater exceptions, in substantial compliance with the terms as discussed with the City Attorney. The motion carried 6 -0 -1 with Councilmember Agnew absent and excused. 12. City Manager Reports None 13. Adjournment Mayor Freed adjourned the regular meeting of the Bothell City Council at 8:05 PM.
